Welcome to The Birthday Times. These Terms of Service ("Terms") govern your access to and use of our website, products, and services (collectively, the "Service"). By using thebirthdaytimes.com.au or placing an order with us, you agree to these Terms. If you do not agree, please do not use our Service.

 

1. Who we are

The Birthday Times is a small business that creates personalised birthday newspapers and related keepsakes. Our contact email is orders@thebirthdaytimes.com.au.

 

2. Acceptance of orders

• All orders placed through our website are subject to acceptance by The Birthday Herald. We reserve the right to refuse or cancel any order for any reason, including product unavailability, errors in product information or pricing, suspected fraud, or concerns about delivery.
• Once you place an order, you will receive an order confirmation email. This confirmation does not mean your order has been accepted; acceptance occurs when we email you a dispatch confirmation.

 

3. Personalisation, proofs, and your responsibilities

• Many of our products are personalised and made-to-order. You are responsible for providing accurate text, images, spellings, dates, and other custom content.
• By accepting the “live preview” you accept that all personalisation details are correct. Once you make the payment we begin production, changes, cancellations, or refunds will generally not be possible (see Refund Policy).
• We are not liable for errors resulting from information you supplied. If you contact us before production starts and we can reasonably change your order, we will do so but cannot guarantee we can always accommodate changes.

 

4. Pricing, payments & taxes

• Prices are shown in AUD and are subject to change without notice. We will charge the price in effect at the time your order is accepted.
• Payment is required at checkout. We accept the payment methods displayed on the website. By providing a payment method you represent that you are authorised to use it.
• You are responsible for any applicable taxes, duties, or import fees related to your purchase.

 

5. Shipping & delivery

• Shipping methods, estimated delivery times, and charges (if any) are displayed at checkout. We aim to meet delivery estimates but cannot guarantee delivery dates due to carrier issues, customs, weather, public holidays, or other factors outside our control.
• You must ensure the shipping address and contact details you provide are correct. We are not responsible for delays or non-delivery caused by incorrect or incomplete addresses.
• Risk of loss and title for items pass to you when the carrier accepts the shipment.

 

6. Returns, refunds & cancellations

• Because many of our items are personalised and made-to-order, refunds, cancellations, and exchanges are limited. See our Refund Policy for full details, including how to request a refund or replacement for damaged, defective, or incorrect items.
• If you believe an item is faulty, damaged, or materially different from what you ordered, contact us promptly at orders@thebirthdaytimes.com.au with your order number and supporting photos or information.

 

7. Intellectual property

• All content on the website (text, graphics, logos, images, designs, and software) is the property of The Birthday Times or its licensors and is protected by copyright and other intellectual property laws.
• By submitting text, photos, graphics, logos, or other materials for inclusion in your personalised product, you grant The Birthday Times a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display that content for the purpose of producing and promoting your order (including marketing and social media), unless you explicitly request otherwise in writing prior to ordering.
• You represent and warrant that you have all rights and permissions necessary to supply content for reproduction and that it does not infringe any third-party rights or applicable laws.

 

8. User content & prohibited items

• You must not submit content that is unlawful, defamatory, discriminatory, obscene, infringing, or otherwise offensive. We reserve the right to refuse to print or reproduce any content that in our judgment violates these Terms or applicable law.
• We may modify or remove user-submitted content at our discretion. 

 

9. Warranties & disclaimers

• To the maximum extent permitted by law, our Service, products, and website are provided "as is" and "as available" without warranties of any kind, whether express or implied.
• We do not guarantee that the colours, textures, or other physical characteristics of a printed product will exactly match what appears on your screen.
• For any statutory consumer guarantees that cannot be excluded (for example, under applicable Australian consumer law), our liability is limited to repair, replacement, or refund as required by those laws. 

 

10. Limitation of liability

• Except where prohibited by law, The Birthday Times and its directors, employees, agents, and suppliers are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service or products.
• Our aggregate liability for any claim in connection with your order or these Terms is limited to the amount you paid for the relevant product.

 

11. Indemnity

• You agree to indemnify and hold The Birthday Times and its officers harmless from any claims, losses, liabilities, costs, or expenses (including legal fees) arising from your breach of these Terms or from content you submit that violates the rights of a third party.

 

12. Privacy

• Our Privacy Policy explains how we collect, use, store, and disclose your personal information. By using our Service, you consent to our collection and use of information as described in the Privacy Policy.

• These Terms are governed by the laws of the state or territory in which The Birthday Times operates (Australia). To the extent permitted by law, you agree to submit to the non-exclusive jurisdiction of the courts located in that jurisdiction for any dispute arising out of these Terms.
